Called USCIS and generated a service request 10 days back...no LUD since then either..frustrating...

1) I agree with all who are asking you to quit and get your H1-B transfered, but my concern is whether your H1-B is still valid or not as your I-140 has been revoked or is still in consideration.
You can search for a company and file for a transfer and can still stay with this company till you get an answer. You can hold multiple H1-B's at the same time.
2) Time taken for an H1-B approval varies, it all depends on your fate.
I would suggest that you give $1000 and get it premium and you would get an answer in two weeks.
3) Yes you can file Labor and I-140 again with the new employer before 2009 and can take extensions.
These are my suggestions, it would be better that you consult a good lawyer to be contended as the lawyer would be dealing with cases more like these then we.

Hi,
Get yourself a good lawyer. As far as I know Up to 180 days of out of status can be managed. As your case is in removal proceedings, it may further complicate your situation.
Even if you get an Advance Parole, do not use it. Your reentry will have issue. You may send a private message.

For a long time, between 2001 to late 2004, All PDs (EB1-EB5) were current. Main reason for this was, labor certification used to take 2-4 years during that time. If you do not have labor certification coming out, you always have visa numbers available. Just when PERM hit, retrogression came in to the picture.

ekauraaya, i didnt mean to sound like the police, but your post did sound a bit harsh. if you didnt intend it then i am sorry as well. the reason i am so touchy is because me and my wife just got done paying off a $25,000 credit card bill that we accumulated while i was a student. no, we werent splurging like crazy to buy the latest gadgets. this was survival stuff like groceries and gas that we had to encounter while in graduate school and being married at the same time, with no financial support from family and very little stipend from university. so we know what its like to live in that nightmare. thank god we are done with it. luckily we never missed any payments and have good credit scores but we know the stress of having a huge debt through bad circumstances even if one is not a spendthrift.
So when you mentioned "goof-ups" to the other guy without knowing his actual history, that set me off on a tirade.

This will also not qualify under EB-2. Your underlying bachelor's degree has to be 4 years equivalent to a U.S. bachelor's degree. secondly, 4-6 experience is not the same as 5 years of progressive experience.

You can add a MouseLeftButtonDown event to pretty much any element! Just select and use the Events tab to set your event handler name: http://www.kirupa.com/net/creating_simple_wpf_gui_app_pg5.htm
Both Blend and VS will auto-generate the event handler where you can insert some code :)

So what I did was drag and drop the icon into my project then turned the icon into a control using the 'Make into control' option (right click option); selected Button from the list and left everthing else as is. From here, I selected button from the tab (says [Button]) under the project name. example: mainpage.xmal).
So basic what this does is overlay the icon image with an actual button control.
Moving on.
I then selected the button (icon image) in my project and in the properties panel (on the right) under 'Common Properties' removed the word "button" from the 'Content' label.
Switched to event view (it's the rectangle with the lighting bolt -- top right) and in the box next to 'Click' gave it a meaningful name, i.e. query_Click or query or something. I think after this the MainPage.xaml.cs should open.

Hi,
I have two I-140 applications and both are from my current emplyer. One was a regular I-140 and the other was a substitute I-140. Both got approved on the same day. Regular had a PD of 04/2007 and substitute had 11/2004.
The regular got approved with PD of 04/2007 and substitute also got approved with 04/2007. So now what are my options of using the 11/2004 PD.
I was expecting USCIS to approve both applications with 11/2004 instead.

Hey dont you think there should be some minim qualifications before you could be filed for as manager, for eg:- MBA or something like that? The so called friend of this guy is not a manager but is going to be made into a manager just for the EB1 purpose. How can they do that. I believe this is a Indian consulting company!!
I work for one of the largest companies in the world and my company has clear policies on work visas and who qualifies for a managerial visa and who does not! I do have an MBA degree and independently manage a $95 million business portfolio and have a small team as well.
It is the propensity on part of some companies to stretch the definition of whats allowed and whats not that creates an impression that there is rampant visa fraud and these visas should be done away with/ made more difficult to obtain.

I have not started the process as yet. Bust basically I am going thru a Franchise Corp to do my application at present. But have kept the option open to buy one outright in a good neigborhood.
