Hi,
I am on H1b visa and it is expiring on Sep 2010. I heard that we need to apply for renewal 3 months before the expiry date,(i.e,June). I am planning to transfer my H1 to another employer. If I do so, will my H1 be automatically renewed during the transfer process? Also, If I transfer my H1 and go out of the country, do I need to get my visa stamping re-done when I come back to the country...
Thanks

Got LUD on I-485 one month after EAD/AP approval. What could this mean?
I got a soft LUD with no change in case status on I-485. PD is July 2006.

Are you really sure that your H1B is still valid? My understanding is, only one type of Visa will be issued to a country for an individual, they cancel previously valid visas.

Hi All
I am here on L2 and then Joined a Company in 2006. When I joined, that time the H1 Cap 2007 was already over so my company said that they will do my H1 this year. Unfortunatly I got the H1 Rejected as my case couldnt get in the lottery.
In the Mean time my company have filed my Green card under EB3 and we have I-140 Approved (1 st stage) in August 07.
Now, is there any way that anyone can Help me?
Thanks

The visa bulletin says "Effective Monday July 2, 2007 there will be no further authorizations inresponse to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation"
But doesnt that mean that no I485 authorizations will happen but filing can still be done and EAD received as de facto?
Please ask your respective lawyers to clarify this with USCICS/DOS.

A friend of mine has submitted visa application fee and has made an appointment for visitor visa next week.
Can someone please tell if there is any other requirement of making a draft for some other fees during the Visa interview? (I am confused because a couple of years ago we used to submit one more bank draft during Visa interview)
Thanks for your advice

Hi everyone:
Can someone suggest if I'm in a hot water over this issue. My company applied for the labor certification back in Dec. 2002. In the Labor Certification form they quoted 40 for the "Total hours per week". The LC was approved back in July of 2007. Later in Sept. of 2007 we filed I-140 and I-485 concurrently.
In April of this year my company received an RFE for the I-140, where USCIS requested some additional translations and my W-2 forms for all the years of my employment. We've responded to it.
So here's my question. Since 2002 my working schedule changed and now I work 32 hours per week, that is different than 40, which was included in the LC. It doesn't say anywhere in my W-2's, but one can easily see that I'm being paid less by doing some simple math.
Do you think this would pose a problem and if so, what shall I do at this point?
Thank you in advance!

I don't meant to scare you but this shit usually happens when they are reconsidering the decision when the sponsoring employer withdraws your H-1B. Check with your company's/lawyer if they accidentally submitted withdrawal of your H-1B petition.

Hi,
I Lost my I797A (but having photo copy) . I want to go to my Home country on emergency for 2 weeks and return to US.
Will I get visa stamping with
1. Copy of I797A and Employee's related documents ?
2. Copy of I797A and Employee's related documents + Proof of Duplication Request ?
3. Whether Duplication form (I-824) Should be separately filed for L1 & L2 ?
Please guide me Immediately.
Thanks in Advanced

The US Men's national soccer team had one of the greatest victories in its history today when it knocked off Spain, the #1 team in the world, at the Confederations Cup in South Africa. There are two immigrants on the roster for the US - Freddy Adu (who I honored after he competed with the US Olympic team last year). The other immigrant is Benny Feilhaber, a Brazilian-born American who moved to the US when he was six years old. When he is not playing on the US national team, he competes for AGF, a Danish team. Before that, he...

A lot of IT professionals born in India justly feel that their immigration cases have been going on forever. We recently concluded a case for an Indian IT professional which was one of the longest and most complex that I have ever encountered. Mr. S received his degree in Computer Science from a prestigious university in the Midwest almost 20 years ago. During the 1990s, he worked for various employers in H-1B status. In 1999 and 2000, his employer obtained the approval of a labor certification and an I-140 visa petition (EB-3) on his behalf. This made him eligible for...

In compliance with the precautionary measures and the travel health warning issued by the Department of State, the U.S. Consulate in Ciudad Juarez is canceling all immigrant visa and waiver appointments from April 30, 2009, through May 8, 2009. Individuals with immigrant visa appointments scheduled during this time will receive a letter with the rescheduled appointment date. Individuals with a scheduled waiver appointment will be contacted via e-mail or phone regarding the rescheduling.
Additionally, appointments for non-immigrant visas that were scheduled between April 29, 2009, through May 5, 2009, will be rescheduled. Applicants will be contacted by the call center via e-mail or phone. Additional information is available at the Ciudad Juarez Web site (http://ciudadjuarez.usconsulate.gov/h1n1.html).
